These Terms of Service govern the use of our website, users (“Clients” or “Customers”), and your interaction with www.ajpremier.com. This Terms and Conditions document (“Agreement”) also incorporates our Privacy Policy and GDPR Compliance Policy. Together, these policies form a unified agreement that governs access to the AJ Premier Professional Services (Tax) website. By accessing www.ajpremier.com, you confirm that you have read, understood, and agree to these Terms without limitation or qualification. You also agree to be legally bound by and comply with them. If you do not accept any part of these Terms, you must discontinue using the website immediately.
These Terms and Conditions ("Agreement") govern the provision of tax advisory and consultancy services ("Services") by AJ Premier Professional Services (Tax) ("Advisor," "we," "our," or "us") to the client ("Client," "you," or "your"). By engaging the Advisor’s services, you agree to be bound by the terms set forth in this Agreement.
1. Scope of Services
The Advisor will provide tax advisory and consultancy services, which may include, but are not limited to, personal tax returns, tax planning, compliance advice, and other related services as requested by the Client. The specific scope of services will be outlined in a separate engagement letter or agreed upon between the parties. The Services are available only to individuals who can be referred to as Customers or Users 18 years or above of age and can enter into a legally binding agreement under the Ireland Privacy laws.
2. Fees and Payment
The Client agrees to pay the Advisor for the Services rendered. The Advisor's standard price list is available on the website, though each case is unique, and the complexity of the matter will be assessed before estimating the fees. The Advisor will provide an estimate based on the scope and complexity of the work involved. Payments are due within 30 calendar days of receiving the invoice unless otherwise agreed in writing.
3. Tax Refund Issuance
3.1. Any tax refunds processed will be issued directly to the Client’s bank account by the Collector General, as per Irish Revenue procedures. The bank details are available in the myAccount/ROS portal where the Client may review and change them. The Agent will not update your bank details.
3.2. The Advisor will provide all necessary documentation to support the refund process but will not receive or manage refunds directly on behalf of the Client.
4. Exceptions to Our Tax Refund Responsibilities:
4.1. AJ Premier Professional Services (Tax) is not responsible for the refund of tax where:
4.1.1. The customer has provided information that is false, inaccurate, incomplete, or misleading in any way;
4.1.2. The customer has already received a refund;
4.1.3. The customer has already applied for a refund, either directly or through another individual or entity;
4.1.4. The customer owes money to the tax authority;
4.1.5. The tax authority has different information on its system than that provided by the customer;
4.1.6. The tax authority’s information leads to a decision that the customer is not entitled to a refund.
4.1.7. If there is a potential case for appeal under the law, AJ Premier Professional Services (Tax) will take such measures, provided the customer’s information allows for it.
4.2. We will make every effort to help the customer resolve these issues, provided we receive all necessary information and instructions from the customer.
4.3. We reserve the right to reject applications that we reasonably believe or suspect may intentionally or unintentionally violate any applicable local or international tax law.
5. Power of Attorney
5.1. When the customer signs a Power of Attorney ("Authorization Form PAYE A1") granting AJ Premier Professional Services (Tax) permission to act as your agent in dealing with all aspects of the filing of my Irish income tax return, including the submission of refund or credit claims, allowances or reliefs, and organize your tax refunds, the customer agrees to pay the fee for the such services.
5.2. You are required to keep all documentary evidence of entitlement to credits/reliefs claimed and taxable income sources, will be held for a period of 6 years beginning at the end of the year of assessment to which the Return of Income and/or claim relates.
5.3. If the customer has signed a Power of Attorney and, with or without our knowledge, has authorized another individual or entity to organize the same refund, the customer remains obligated to pay the fee for the refund organization to AJ Premier Professional Services (Tax), even if the refund is obtained through other means.
5.4. If the relevant tax office sends the refund directly to the customer rather than to AJ Premier Professional Services (Tax), the customer still owes the full processing fee for the services rendered that led to the issuance of the refund.
5.5. Once authorized and registered as your tax agent with the relevant Tax Authority, all correspondence regarding your application must be handled directly by AJ Premier Professional Services (Tax). Any direct communication with the tax office by the customer without consulting the Advisor first will be considered a breach of contract, and our applicable processing fee will still apply for all work completed during the application process.
6. Payment Terms
6.1. Upon completion of services, the Advisor will issue an invoice to the Client, detailing the services provided and the agreed fees.
6.2. Payment is due within 30 calendar days of receiving the invoice.
6.3. Late payments will incur a daily interest rate of 0.5%. The Advisor reserves the right to engage debt collection agencies to recover unpaid amounts. Any additional costs incurred during the recovery process will be charged to the Client.
6.4. If the customer fails to pay this fee voluntarily or upon request from AJ Premier Professional Services (Tax), the Advisor reserves the right to:
6.4..1. Take legal action to recover the fee due;
6.4.2. Publish the customer’s name as a Bad Debtor in local newspapers, on the Advisor's website, and in other media if the fee remains unpaid within the reasonable terms provided;
6.4.3. Report the customer as a Bad Debtor to relevant financial institutions;
7. Client Responsibilities
The Client agrees to provide accurate, complete, and timely information necessary for the Advisor to perform the Services. The Client acknowledges that any failure to provide such information may result in delays or inaccuracies in the tax services provided.
8. Confidentiality
8.1. Both parties agree to maintain strict confidentiality regarding all information exchanged during the provision of services.
8.2. The Advisor will comply with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018, ensuring the secure handling, storage, and processing of personal data.
9. Indemnity
9.1. The Client agrees to indemnify and hold harmless the Advisor, its employees, agents, and subcontractors from any claims, losses, damages, or liabilities arising from:
9.1.1. The Client’s failure to provide accurate or complete information;
9.1.2. Any misrepresentation or omission made by the Client in relation to their tax affairs;
9.1.3. Any legal or financial consequences arising from the Client’s failure to comply with Irish tax laws or regulations.
10. Limitation of Liability
The Advisor’s liability to the Client for any claim arising out of the provision of services shall be limited to the total amount of fees paid by the Client for the services rendered under this Agreement. The Advisor shall not be liable for any indirect, consequential, or punitive damages, including but not limited to loss of income, business interruption, or reputational damage.
11. Force Majeure
Neither party shall be liable for any delay or failure to perform their obligations under this Agreement if such delay or failure is caused by events beyond their reasonable control, including but not limited to natural disasters, war, civil disturbance, or governmental actions. In such cases, the affected party must notify the other party promptly and make reasonable efforts to mitigate the impact of the event.
12. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the matter through informal negotiations. If the dispute cannot be resolved informally, the parties agree to engage in mediation before resorting to legal action. If mediation fails, the dispute will be resolved through arbitration in accordance with the laws of Ireland.
13. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The parties agree to replace any invalid provision with a valid one that most closely reflects the original intent.
14. Assignment
The Client may not assign or transfer any rights or obligations under this Agreement without the prior written consent of the Advisor. The Advisor may assign or transfer its rights and obligations to any third party, provided that the Client is notified in writing.
15. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral, regarding the subject matter of this Agreement. Any amendments or modifications to this Agreement must be made in writing and signed by both parties.
16. Notices
All notices or communications required or permitted under this Agreement shall be in writing and delivered to the postal addresses provided by the parties at the time of registration or through email. Notices shall be deemed received upon delivery or transmission.
17. Disclaimer
Your use of this website and its services is entirely at your own risk. AJ Premier Professional Services (Tax) and www.ajpremier.com shall not be held responsible for any direct, indirect, incidental, or consequential damages or losses resulting from your access to or use of our website. We disclaim liability for any loss or damage—whether arising from contract, tort (including negligence), breach of statutory duty, or otherwise—that may occur in connection with your use of or inability to use our website, or reliance of any content displayed on our website, even if such loss or damage was foreseeable.
19. Referral Incentive Terms
We welcome and appreciate client referrals. Once a referred client has been successfully onboarded, the referrer will receive a referral incentive in the form of a credit. This credit will be applied to the referrer's next invoice and cannot be refunded, transferred, or exchanged for cash or any alternative method. The incentive is valid only for use against the subsequent invoice.
20. Client Acknowledgment
By accepting this Agreement, the Client acknowledges that they have read, understood, and agree to the terms and conditions outlined herein.
The Client also confirms that they have had the opportunity to seek independent legal advice before entering into this Agreement.
